DISCLOSURE OF SECRETS CRIME CAUSED BY THE IMPLEMENTATION OF WITNESS PROTECTION ACT NO. 5726

ABSTRACT
Witness statement is one of the most important evidences in criminal proceedings. The witness is someone in direct contact with concrete case. In this respect, it is necessary that the witness must declare in complete freedom to reveal the truth. Some measures were regulated in Criminal Procedure Law and some other legislation for the protection of the witness from existing and potential effects. In particular, The Witness Protection Act No.5726 contains measures for the protection of witnesses in investigation and prosecution stages. One of these measures is to punish the disclosure of secrets learned during the implmentation of the wit ness protection procedures. Article 20 of the Witness Protection Act has regulated that thedisclosure of the secrets learned in this way is a crime regulated on article 258 of theTurkish Criminal Code and named “disclosure of task-relatedsecrets”. However , there are some fundemental differences between these two codes.
